Author: Byron JonasProspective customers should apprise themselves of the pitfalls of nursing homes. They need to learn when they may be in violation of federal law. If there is lack of knowledge, prospective customers may rue their ignorance at a later time.
With a graying population adult offspring have to expect facing the difficult decision of best providing care for those unable to live independently. If taking care of their parents themselves is not an option or no longer seems manageable, such a facility may become the next consideration. The quality of care can vary substantially and there are other variables that need to be considered in this regard.
To prevent loneliness caused by infrequent family visits, the location of the facility is a key factor. The limitation of personal freedom may become an issue. Care quality must be carefully evaluated. Despite being subject to heavy regulation, quality is not consistent. A report released in 2008 by the Government Accountability Office revealed inspectors typically either disregarded or minimized problems that could pose serious harm to patients.
Patient care. The kind of care received can be tailored to preferences to some degree. Federal law permits future residents and their family to have a role in developing a care plan. Staff must make reasonable adjustments to respect patient preferences. It should be known that feeding tubes and restraints may only be used as last resorts. Mood drugs can only be prescribed for treatment of specific conditions and not for staff convenience. It should be known that staff may limit the amount of care or apply methods to make their jobs easier rather than benefit their charges.
Consider issue of not becoming a Responsible Party on admission. Family should not be asked to become financially liable for expenses. They are not required to accept the responsibility of becoming the responsible party. However, federal law prohibits this requirement.
Consider limits of Medicare reimbursement. Medicare does not provide comprehensive cover age. Reimbursement will be limited to certain conditions. There should be proper understanding of what these conditions are. The service provider may also decide to not bill Medicare. If this action is taken, provision of written notice is required. Service recipients are also not obligated by this decision. They have the right to insist for the submission of a bill for payment.
Medicaid. Medicaid tends to pay lower rates than Medicare or private payers. As a result, lesser quality services may be provided to its recipients. However, federal law prohibits discrimination based on Medicaid status.
Consider the possibility of eviction. Due to great demand and limited supply and common understaffing, a nursing home may decide to evict certain patients. However, eviction is allowed for a handful of causes. These restricted causes are going out of business, payment failure, care is no longer required, patient needs are beyond capacity of the service provider or that the health or safety of fellow residents is endangered by the presence of the patient. Written notification with is supporting evidence is required within a certain time frame of eviction. The notification must provide the contact details of the licensing and inspection bodies and indicate how the determination can be appealed. The pitfalls of nursing homes require potential users to exercise vigilance in their assessment of potential choices.
